Legal Notice

1. Who We Are

Company: Dilo — [à confirmer : raison sociale, adresse, numéro d'entreprise]

Email: [à confirmer]

Website: [à confirmer]

2. Eligibility to Use the Site

To browse the Site or buy from us, you need to be 18 or older and legally able to sign a binding contract. Each time you use the Site, you confirm that you meet these conditions and that the details you give us are accurate, current, and complete.

3. Using Our Products and Health Disclaimer

Dilo products are meant for personal use, following the directions printed on the packaging. Everything published on the Site — product pages, photos, videos, customer reviews, and articles — is shared for general information only.

No content on the Site is medical or dental advice, a diagnosis, or a treatment. Dilo Oragel does not replace care from a dental professional. Talk to a licensed dentist or prosthodontist about how your dentures fit, their condition, or replacing them, and check with them before using any product if you have mouth sores, an infection, a known allergy, or any other medical concern.

If you notice irritation, discomfort, an allergic reaction, or any other unwanted effect, stop using the product right away and get professional advice. Always read the complete ingredient list before use.

4. Individual Results Differ

What you experience may not match what someone else experiences. It depends on things like how much bone loss you have, the condition and age of your denture, how well it fits, and how carefully the directions are followed. Reviews and testimonials describe personal experiences and are not a promise that you will get the same outcome.

5. Orders, Prices, and Availability

Every order depends on our acceptance and on stock being available. We may refuse, limit, or cancel any order at our discretion, including orders that look like they come from resellers, distributors, or fraudulent buyers.

We work to keep prices and product information on the Site correct. If a typo or system error causes a product to show the wrong price or details, we may cancel the affected order — even once it has been confirmed — and refund the full amount you paid.

Prices are shown in U.S. dollars and may change without notice. Where it applies, sales tax is added at checkout.

6. Subscriptions and Automatic Renewal

By starting a subscription, you allow us to charge the payment method you chose on a repeating basis, at the frequency and price shown at checkout. Your subscription keeps renewing on its own until you cancel it.

How to cancel: you can cancel any time before your next billing date by (1) signing in to your account on this website and cancelling from the customer portal, or (2) emailing [à confirmer] with your name, your order number, and your request to cancel.

Cancelling only stops charges going forward. Subscription orders that have already been billed cannot be refunded. If your subscription price changes, we will let you know before the new price applies.

7. Payment and Billing Questions

You confirm that you have the right to use the payment method you enter at checkout. When you place an order, you allow us to charge the full amount, including any taxes that apply.

If something about a charge concerns you, please email [à confirmer] before contacting your bank or card provider. If a chargeback or payment dispute is opened on an order that was correctly charged and delivered under these Terms, we will contest it and share supporting records, which can include order details, billing authorization, account activity, IP and device data, our messages with you, and the carrier's delivery confirmation. Accounts linked to unjustified chargebacks may be suspended and future orders declined.

8. Shipping and Delivery

We ship orders as described in our Shipping Policy. Ownership of the product and the risk of loss pass to you once the package is handed to the carrier. The carrier's delivery confirmation, including any proof-of-delivery photo, counts as evidence that the order arrived.

9. Refunds and Returns

Every refund or return request is handled under our separate Refund & Returns Policy, which sets out our 60-Day Money-Back Guarantee and who qualifies for it. We look at each request individually.

10. Authorized Sellers

Dilo products are sold only on this website. We have not authorized any other seller to distribute them. We cannot confirm that products bought elsewhere are genuine, and those purchases are not covered by our Money-Back Guarantee.

11. Intellectual Property

Everything on the Site — the Dilo name, logos, trademarks, product names, text, graphics, photos, videos, packaging designs, and software — belongs to Dilo or is licensed to us, and is protected by U.S. and international intellectual property laws.

You may view and print Site content for your own personal, non-commercial use. Without our written permission, you may not copy, reproduce, edit, distribute, republish, display, sell, scrape, or build derivative works from any content on the Site.

12. Reviews and Content You Send Us

When you send us a review, photo, video, comment, or any other material ("User Content"), you give Dilo a permanent, irrevocable, worldwide, royalty-free, transferable, and sublicensable right to use, reproduce, adapt, publish, display, and distribute it — together with your first name and last initial — in any format and for any purpose, including advertising and promotion.

You confirm that your User Content is truthful, reflects your genuine experience, was created by you or belongs to you, and does not infringe anyone else's rights. We may take down User Content at any time, for any reason.

13. What You May Not Do

When using the Site, you agree that you will not:

  • Use it for anything unlawful or misleading
  • Place orders with false information or payment methods you are not allowed to use
  • Buy products to resell them without written approval from Dilo
  • Use bots, scrapers, or other automated tools to access the Site or collect its data
  • Try to break into or disrupt the security, servers, or networks behind the Site
  • Upload viruses, malware, or any other harmful code
  • Pretend to be someone else or misstate your connection with any person or organization

14. Disclaimers and Limits on Liability

NO WARRANTIES. OTHER THAN WHAT IS EXPRESSLY STATED IN OUR REFUND & RETURNS POLICY, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." AS FAR AS THE LAW ALLOWS, DILO REJECTS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITE WILL RUN WITHOUT INTERRUPTIONS, ERRORS, OR HARMFUL COMPONENTS.

LIMITED LIABILITY. AS FAR AS THE LAW ALLOWS, DILO AND ITS OWNERS, OFFICERS, STAFF, AGENTS, SUPPLIERS, AND AFFILIATES WILL NOT BE RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS — RESULTING FROM YOUR USE OF THE SITE OR OUR PRODUCTS. FOR ANY CLAIM, OUR TOTAL LIABILITY WILL NEVER BE MORE THAN WHAT YOU PAID FOR THE PRODUCT CONCERNED.

Some jurisdictions do not allow certain warranties to be excluded or certain damages to be limited. Where that is the case, our liability is limited as much as the law permits.

15. Resolving Disputes, Arbitration, and Waiver of Class Actions

Try to settle it informally first. Before starting any formal claim, you agree to write to [à confirmer] and to work with us in good faith for at least 30 days to resolve the issue informally.

Binding arbitration. Any dispute, claim, or disagreement about these Terms, the Site, or a product that is not resolved informally will be decided by binding arbitration on an individual basis, run by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. Hearings will be held in the county where you live or by video, and any award may be entered as a judgment by any court with jurisdiction.

No class actions. YOU AND DILO EACH AGREE TO BRING CLAIMS AGAINST THE OTHER ONLY INDIVIDUALLY. NEITHER OF US MAY TAKE PART AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. YOU GIVE UP YOUR RIGHT TO A JURY TRIAL.

Exceptions. Either of us may bring an individual claim in small claims court when it qualifies. Either of us may also ask a court for injunctive relief to protect intellectual property.

Opting out. You can opt out of this arbitration section by emailing [à confirmer] within 30 days of your first purchase or of creating your account. Include your name, your mailing address, and a clear statement that you are opting out.

If the class action waiver is found to be unenforceable, all of Section 15 no longer applies — except the jury trial waiver, which stays in force to the extent the law allows.

16. Indemnification

You agree to defend, indemnify, and hold harmless Dilo and its owners, officers, staff, agents, and affiliates against any claims, damages, losses, liabilities, costs, and expenses — including reasonable attorneys' fees — that result from your breach of these Terms, your misuse of the Site or products, User Content you send, or your violation of any law or anyone else's rights.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of [à confirmer : État] and by applicable federal law, without applying conflict-of-law principles. Subject to Section 15, any court case must be brought only in the state or federal courts located in [à confirmer : comté et État], and you consent to those courts' personal jurisdiction.

18. Copyright Complaints (DMCA)

If you think content on the Site infringes your copyright, send written notice to [à confirmer] that includes: (1) your physical or electronic signature; (2) a description of the copyrighted work; (3) the material you believe is infringing and where it is located on the Site; (4) your contact information; (5) a statement that you believe in good faith the use is not authorized; and (6) a statement, made under penalty of perjury, that your notice is accurate and that you own the rights or are authorized to act for the owner.

19. Electronic Communications

By using the Site or ordering from us, you agree to receive communications from us electronically, such as order confirmations, shipping updates, and policy notices. These electronic messages meet any legal requirement for written notice. We only send marketing emails and text messages if you have agreed to receive them, and you can stop them at any time using the unsubscribe instructions included. Your usual message and data rates may apply.

20. Privacy

Your use of the Site is also covered by our Privacy Policy, which explains how we collect, use, and protect your personal information.

21. Accessibility

We want the Site to work for everyone. If any part of it is hard for you to use, email [à confirmer] and we will do our best to help.

22. Links to Other Sites

The Site may link to websites or services run by other companies, such as payment providers and shipping carriers. We do not control them and are not responsible for their content, practices, or policies.

23. Events Beyond Our Control

We are not liable for delays or failures caused by events we cannot reasonably control, including natural disasters, carrier disruptions, strikes, supply chain problems, government orders, public health emergencies, cyberattacks, or internet outages.

24. Information for California Residents

Under California Civil Code Section 1789.3, California residents can send complaints to the Complaint Assistance Unit of the Division of Consumer Services, California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or call (916) 445-1254 or (800) 952-5210.

25. Ending Access

If you break these Terms or act in a way we believe harms Dilo, our customers, or anyone else, we may suspend or close your access to the Site or your account at any time and without prior notice.

26. Changes to These Terms

We can update these Terms whenever needed. Changes take effect as soon as they are posted on this page with a new "Last Updated" date. If you keep using the Site or buying products after an update is posted, you accept the new Terms. Updates do not apply to disputes that started before the change.

27. Other Terms

Whole agreement. These Terms and the policies they mention are the full agreement between you and Dilo about the Site and our products.

Severability. If a court finds any part of these Terms invalid or unenforceable, the rest remains fully in effect.

No waiver. Choosing not to enforce a provision at one point does not stop us from enforcing it later.

Assignment. You may not transfer these Terms to anyone without our written consent. Dilo may transfer its rights and obligations without restriction.

Headings. Section titles are there to make reading easier and have no legal effect.
